The weed and root killer Roundup™, which is currently the most popular and best selling herbicide in the world, is being investigated for claims that its active ingredient “glyphosate” may be linked to an increased risk of cancer, or more specifically, non-Hodgkin’s Lymphoma (NHL). Plaintiffs also claim that the product’s manufacturer, Monsanto, failed to sufficiently warn its users of these increased risks in order to avoid profit losses, as the company has known of the link between its product and potential cancer cases for more than 30 years.

Lawsuit Allegations

Lawsuits filed against Monsanto (the manufacturer of Roundup™) contain a combination of the following allegations:

  • Exposure to glyphosate can cause cancer
  • Monsanto has known that exposure to glyphosate presents human health risks, including a risk of developing cancer
  • Monsanto’s Roundup™ labels fail to warn consumers about the risk of cancer
  • Monsanto misrepresented Roundup’s health and environmental risks, ultimately misinforming government agencies, farmers, and the public of its safety issues

Injury Criteria

Only B cell or T cell non-Hodgkin’s Lymphoma (“NHL”) or its subtypes:

  • Follicular lymphoma
  • Chronic lymphocytic leukemia
  • Mantle cell lymphoma
  • Diffuse large B-cell lymphoma
  • Hairy cell leukemia
  • Other

NHL/cancer diagnosis must be at least 12 months after initial use. The official criteria has yet to be determined, so any injury you may have suffered due to Roundup exposure could qualify.

Exposure Criteria

  • Duration: At least one month of exposure or two weeks per year for two years. Limited exposure may also qualify, ask one of our Roundup™ attorneys.
  • Cause: At-home use (i.e. using roundup to kill weeds in a garden) or commercial use (i.e. person working as a landscaper or on a farm).
  • Indirect Exposure: May be a weaker case, discuss with one of our Roundup™ attorneys if your case is strong enough for litigation (i.e. rode on tractor while someone else sprayed; someone washed farmer’s clothes after spraying).
  • Time Restrictions: Last Roundup use cannot be prior to 1985.

Age Limitations

  • Cases in which plaintiff is under 80 have the best chances of successful litigation.
  • The strongest cases are for those who are under 65 at the time of diagnosis.
