Could Your Vaccine Injury Have Happened in New York?

If you received a flu shot, Tdap, or another routine vaccine in New York and developed shoulder pain, weakness, numbness, or neurological symptoms afterward, your experience may qualify as a vaccine injury under federal law.

Many New Yorkers we represent were vaccinated during everyday situations, stopping at a local pharmacy, attending a workplace flu clinic, or receiving a routine shot through a hospital or community provider. At the time, nothing seemed unusual. Symptoms often appeared days or weeks later.

Common signs New York clients report include:

  • Shoulder pain that didn’t improve after a flu shot
  • Limited range of motion or a “frozen shoulder”
  • Numbness, tingling, or weakness in the arm or hand
  • Neurological symptoms such as balance issues or persistent fatigue

If these symptoms lasted for months or required medical treatment, you may be eligible to file a vaccine injury claim, even if no one told you something went wrong.

Vaccinated at a New York Pharmacy? Shoulder Pain May Be a SIRVA Injury

A large number of New York vaccine injury claims involve shoulder injuries after vaccinations given at retail pharmacies, including CVS, Walgreens, Rite Aid, and grocery-store pharmacies.

Many New Yorkers later learn that:

  • The injection was placed too high or too deep in the shoulder
  • Pain began shortly after the shot and never fully resolved
  • Imaging showed bursitis, tendon damage, or joint inflammation

These injuries are commonly diagnosed as SIRVA (Shoulder Injury Related to Vaccine Administration) and are eligible for compensation through the National Vaccine Injury Compensation Program.

You do not need to prove that the pharmacist or provider made a mistake, and you do not have to sue anyone to pursue a claim.

New York Vaccine Injury Settlements

Flu Shot - Shoulder Tendonitis - $192,500

A New York woman suffered a severe shoulder injury after receiving a flu shot at a local pharmacy. Within 48 hours, she experienced intense pain and loss of mobility in her arm. She was diagnosed with Shoulder Injury Related to Vaccine Administration (SIRVA), which included bursitis, tendonitis, and adhesive capsulitis.

Her treatment involved several months of physical therapy and multiple steroid injections. When these treatments did not provide adequate relief, she underwent an arthroscopic rotator cuff repair. Despite the surgery, she continued to experience pain and a reduced range of motion. Due to the severity of her condition and the impact on her daily life and employment, she sought legal assistance and successfully secured a settlement.

How the National Vaccine Injury Compensation Program (VICP) Works for New York Residents

A clear, no-cost path to pursue compensation through the federal program

If you suffered a vaccine injury in New York, you may be eligible for compensation through the National Vaccine Injury Compensation Program (VICP)—a federal, no-fault alternative to traditional litigation. Here’s how it works:

1

Free Case Evaluation

Contact our New York vaccine injury lawyers for a free, confidential review. We assess VICP eligibility and timing (typically 3 years from the first symptom for injury claims).

2

Petition Filing

We file your petition with the U.S. Court of Federal Claims in Washington, D.C. VICP is federal—New York residents qualify regardless of where they received the vaccine.

3

Medical Review

HHS reviews your medical records and may request more documentation. We coordinate with your New York providers to submit complete, well-supported evidence.

4

Settlement or Hearing

DOJ may offer a settlement; if not, the case proceeds to a hearing before a Special Master. You pay nothing—the VICP covers attorney’s fees and case costs.

5

Compensation

Eligible damages include medical costs, lost wages, pain and suffering, and in severe cases, ongoing care. Typical SIRVA settlements range from $100,000 to $200,000; actual amounts vary.

New York Vaccine Law & Your Rights

What New York residents should know when pursuing federal VICP claims

While vaccine injury claims are handled at the federal level through the VICP, New York residents should be aware of several state-specific considerations that affect records, requirements, and process logistics.

NY

New York & Federal VICP Process

New York does not run its own vaccine injury fund. Claims are brought in the federal U.S. Court of Federal Claims through the VICP, and most steps can be handled remotely from anywhere in the state.

$

Your Right to Compensation

New Yorkers have full access to the federal VICP. State statutes of limitations do not govern VICP claims—only federal deadlines apply (generally 3 years from first symptom for injury; different timelines for death claims).

RX

Medical Records Access (New York Law)

Under New York Public Health Law §18, providers must give patients an opportunity to inspect their records within about 10 days of a written request. Copies must be provided within a reasonable time (HIPAA allows up to 30 days in most cases). Prompt, complete records strengthen your VICP case.

  • We request records from hospitals, clinics, pharmacies, and PT/imaging offices statewide.
  • We help document onset timing, diagnosis, and treatment to support your claim.
NF

No-Fault Compensation

Unlike typical personal injury cases, the VICP is no-fault. You don’t need to prove negligence—only that you received a covered vaccine and suffered a qualifying injury within the deadlines.

Practical Tip for New Yorkers

VICP cases are heard in Washington, D.C., but you don’t need to travel. Our team manages filings, hearings, and communications remotely for clients across NYC, Long Island, the Capital Region, Western NY, and beyond.
